The Smith’s plans were abruptly disrupted. They received a 60-day notice to vacate their previous home due to the landowner's urgent need to sell. As they searched for a new home, they came across a rental property with ownership options advertised at Mariposa Market. The landlord, described as a retired wealthy philanthropist, offered a 30-year lease with a purchase option, requiring a down payment and deposit.
Mr. Smith and his family embarked on a significant transition, relocating their belongings from their home, woodworking shop, plumbing office, and storage facilities. The goal was to house his plumbing business, wood shop and establish a new online collectibles and gadgets retail business for his daughters, which would serve as a source of income and a learning experience in running a small business while attending high school. Moving their inventory, which Mr. Smith had accumulated over the past few years and had inherited a good portion of it as well, including antiques, collectibles, and other treasures. The relocation process was a massive undertaking, requiring three to four weeks to complete. The family had to navigate the challenges of packing and moving simultaneously, which is never ideal. To make matters more complicated, they were also performing an overwhelming amount of necessary repairs and maintenance at their new ranch and home, aiming to restore it back to being habitable. This proved to be a more extensive project than initially estimated, requiring significant labor and resources. The renovation involved replacing fixtures and water closets, installing new light bulbs, and upgrading exterior lighting fixtures. Additionally, Mr. Smith built a custom wood rack and woodworking equipment to establish a custom wood crafting shop for his hobby and business. They devoted over five hundred hours of labor to cleaning, repairing, upgrading, and preparing the property in anticipation of relocating their family once it was ready. However, when they began the relocation process, they discovered that their agreement with the previous landlord was not being honored. The landlord had listed their $3,000 chicken coop to be included with the sale of the rental property when it was built intentionally to be relocated later time. Mr. Smith had built for his wife's birthday and designed to be easily relocated as per the landlord's request, but he secretly had listed it as part of the property in his real estate advertisement. Additionally, the landlord ended up skipping town without conducting the final inspection and ceased all communication with the Smiths. As a result, the Smiths were unable to retrieve their deposit nor their $3,000 chicken coop amongst other valuable items. Despite having permission and additional time to remove two loads of items not yet relocated, they were locked out and left with unanswered calls.
Before the following events took place Mr. Smith was known for his giant American flags and extravagant patriotic decoration and was the biggest patriot. The smith family always has a flag hanging and says the pledge of allegiance and stands for the anthem, and they even pray daily. The Notice was served 10 days before Christmas. The most disrespectful timing we can think of, there obviously was zero forethought or thought at all before that major screw up. It just goes to show you where the government’s head is at when it comes to caring about the everyday citizen. They graciously back pedaled once they realized that there was an innocent family living in the property they were set to steal, and had served during the holiday, the worst gift ever. Mr. Smith took this time as a opportunity even though he was distraught in dis belief and at a loss for words he buckled down to give himself a degree in federal forfeiture law because he believed when your innocent there had to be a way to assert his claim to be a rightful owner or purchaser of the property and a way to protect his investment.
Mr. Smith said he remembers he kept thinking. “How could this be true? As he delved into the complexities of federal forfeiture law, hoping to find a legal foothold. His efforts seemed futile after his discussion with US Attorney Pamela Stanek on January 4th when he was told he was a squatter and had no rights to the property. Along with learning the law he started writing emotionally charged letters sounding crazy, to whomever he could think of that might be able to help him. Calling and writing local advocates and attorneys called every attorney he could find in California and Indiana. Going as far as emailing and calling every attorney on the State Bar lists. Unable to retain or even find an attorney to counsel them, finding that attorneys did not want to mess with his smalls case or give him the time of day because there was no money in it for them. when he received a response from a letter, he had written a month prior to the judge seeing over the criminal case for money laundering confirming that Stanek had misled them to think they had no rights, and they did in fact have the right to file a claim in court. This misinformation had already cost him precious time.
Complications continued as he faced a personal crisis. His daughter suffered a severe injury during a high school CIF wrestling championship tournament and was rushed to the Children’s hospital in Berkley, leading to emergency first of its kind lifesaving surgery. This family emergency took Mr. Smith away during the courts strict 30-day deadline for his right to the property together presenting away from my legal struggles, costing me critical days as he looked after his daughters care and being her supportive parent assuring things would be OK. He couldn’t leave his daughter without her father there giving her his courage and strength to endure the scary surgery she went thru during a period of personal turmoil and increasing legal challenges, the complexity of his situation deepened.
Mr. Smiths is still waiting for the report to be completed that is needed for him to file a claim for his losses. He waits still to this day he has not been able to pick a report up for this event. Come to find out, they never followed up with any of the leads nor did they pass notice of this crime onto the federal authorities after they were asked to do by Mr. Smith after he provided them with all the relevant contact information. Mr. Smith figured they would be the first call they made since they have what Mr. Smith describes as the number one suspect on supervised release from federal trial with an ankle monitoring her location. Mr. Smith thought he would hear from the Feds, or they would be arriving the very next day to do their own reporting, but that did not happen.
A week after the Ex Parte hearing he had missed and still no news from the sheriffs he contacted them to see if they reported the crime to the government and to the numbers he had provided initially. That question has been diverted from being answered in every reply to Mr. Smith has received in response.
So only finding out about the notice to vacate the night before the lockout was set to happen, he had to run an add hiring Craigslist movers, not ideal but he was desperate. Family friends came from 100 miles away to work all night trying to remove the most valuable items. They got screwed once again by their government.
Mr. Smith had already secured a rental home by borrowing money and had previously moved his family and their household belongings. Just enough to make his family comfortable and safe at the new home, after the death threat he no longer wanted them anywhere near the property. They gathered any able bodies and worked through the night, vacating first the 3500 sq ft home, then the 1600 sq ft guest home, and finally the 100 ft square barn with a 70 ft commercial building that housed his woodworking shop, my online retail business inventory, my grandfather's estate, and my plumbing shop and office. The marshals ended up giving them more time but only day by day adding up to over a week’s time. Causing for a move that almost killed Mr. Smith, moving three days without sleep.
That week he endured more theft with his old work truck being robbed of its stereo and more tools were stolen. This happen while they were vacating, and the truck sat waiting unable to be towed until the last day. They worked tirelessly for a week straight, night and day, and barely got it all moved. He was forced to unload two semi-truck loads of belongings into the driveway of their new rental home. A week later causing a riff with their new landlord who wanted it all gone within the months’ time.
He ended up having to have a fire sale selling off items he really did not plan to get rid of and then having to donate two trailer loads of items he still is not sure what all got donated, he did not have time to choose very well and has a feeling he is going to find he mistakenly gave away valuable items or heirlooms. Being under pressure and in a hurry.
Still unable to work due to not having a work vehicle nor the tools to complete the jobs due to the fact someone came and cut his brake lines causing him to just about wreck and possibly get injured almost crashing into their new home. The van now sits with no brakes without any tools inside it. He was forced to either sell or gave away half of his inherited possessions. He now has no way to make a living efficiently and is turning away 90% of the service calls he receives because his van and equipment are gone. His bills don’t stop or get a reprieve. He can’t get help in the normal channels without a police report. He has utilities are still due for the last two months from the meters on his two houses and barn at the ranch their car and auto insurance is past due and probably being dropped. Mr. Smiths wife gets enough income to keep them feed.

The family stayed behind while Mr. Smith, his brother-in-law Jesse, and part-time help from his plumbing business relocated to the new property. They began moving the Smiths' business, woodworking hobby shop, online retail merchandise, and the family estate Mr. Smith had just inherited into the barn and shop at the new property. They spent most days performing repairs and fire abatement since the property was initially uninhabitable. They addressed busted water lines, a failed backflow unit, a collapsed leach field, and needed to re-pipe the sewer system. The home required a roof leak fix, indoor damage mitigation, and kitchen and laundry room remodeling. They installed a new ceiling and a larger door in the laundry room to fit the dryer, cut cabinets to allow a full-sized refrigerator, repaired the deck to prevent injuries, and secured the upper deck where the guard rail had rotted out. They also dug up and repaired two water main lines and the line to the barn. Additionally, they took care of abandoned sheep, had them sheared after three years of neglect, and arranged for the neighbor's horse grazing on the property to have its feet and teeth looked at and trimmed.
They hauled off over 12 trailers of garbage and debris and made 10 burn piles in the pasture after a month of fire abatement and tree harvesting. They professionally cleaned and painted the walls in the guest house and the larger home, installed new fixtures, a kitchen faucet, a garbage disposer, and drain piping, and re-piped the big house’s waste plumbing system due to incorrect glue and fittings, which caused fittings to blow off.
Mr. Smith also dealt with 40 head of cattle abandoned on the property. After meeting the owner and agreeing verbally on terms, the owner later stole the property generator that powered the well and pump house. She also snuck her cattle off the land at night, cutting locks, and causing over $5000 in damage to greenhouses, the well house pump shed, and the water tanks. Mr. Smith had to save the cattle from drought by providing water after they started showing severe signs of thirst.
Throughout all this, Mr. Smith and his team transitioned their belongings to the new property while undertaking necessary repairs and maintenance. They invested significant labor and resources in improving the property, including replacing fixtures and establishing a woodworking business on-site.
The Smith family noticed US Marshals taking pictures of their property. Five days later, a contingent of twelve marshals arrived, presenting them with a shocking 30-day notice to vacate the property. This notice disrupted their plans for a family housewarming party set for the holiday season.
The Smith family sought answers and engaged in numerous discussions with various legal and governmental entities. Assistant US Attorney Pamela Stanek informed them that they had no rights to the property. They were deemed squatters under a Lis Pendens filed before their purchase agreement, nullifying their contract. This left them feeling helpless and manipulated.
An Ex Partee-hearing was scheduled via Zoom. On the day of the rescheduled hearing, they found out 30 minutes before the hearing that their tools had been stolen. These tools were crucial for their work and would cost $30,000 to replace, an amount they could never afford without insurance.
The Smith family had already secured a rental home by borrowing money from friends and had moved some of their belongings. During this chaotic week, their work truck was robbed, with the stereo and more tools stolen while they were vacating and unable to have it towed until the last day.
The Smith family had to hold sales to offload some of the stuff as it would not fit into the garages that came with their rental. They held one sale, then it rained, and then they had to work. Now, they are having another sale, still unable to work because they have no tools. During the last day of moving, they came and cut their brake lines. They almost crashed moving the van to the new house. The van now sits with no brakes and no tools in it.
The Smiths are still in the same troubled waters The Sheriffs have not completed their report of the crimes committed against the Smith’s and so far they have been unable to obtain any financial assistance.
The Smith family needs legal aid to help them navigate the complexities of their situation. They had been actively searching for and requesting legal aid, which we believe was unjustly withheld from them. It is important to note that if this were a civil case or matter involving their primary residence, the Smiths would have been provided with legal counsel as a matter of course from the courts.
The local law enforcement agencies would have demonstrated a heightened seriousness and understanding of the matter at hand by providing all possible assistance to help the Smith family they could have given some hope for justice.
